General Conditions of Sale


1 Object

The purpose of the General Terms and Conditions of Sale is, on the one hand, to inform any potential buyer of the terms and conditions under which the seller (hereinafter "MADEMOISELLE CHAUVIN") proceeds with the sale and delivery of the products ordered and, on the other hand, to define the rights and obligations of the parties in the context of the sale of products by MADEMOISELLE CHAUVIN to the consumer (hereinafter and hereinafter "the Buyer", "the Customer" or "the User"). They apply, without restriction or reservation, to all sales of products offered by MADEMOISELLE CHAUVIN on its website (hereinafter the "Site" or "the Website").

Consequently, the fact that the Buyer orders a product offered for sale on the MADEMOISELLE CHAUVIN Website implies full and complete acceptance of these General Conditions of Sale, which the Buyer acknowledges having read prior to placing his order.

MADEMOISELLE CHAUVIN reserves the right to modify these General Terms and Conditions of Sale at any time, without notifying the buyer. However, the General Terms and Conditions of Sale applicable to the order are those accepted by the Buyer at the time of placing the order.

2 Formation of the contract & Legal notices

The purchase contract is concluded with MADEMOISELLE CHAUVIN, under the trade name MADEMOISELLE CHAUVIN.

By placing products in our online store, we submit the following general terms and conditions of sale for any order placed on our Site, from the moment the user clicks on the button to order. They will then receive a confirmation email. A contract binding both parties (our Website and the User) can therefore be concluded in advance as follows:

  • If you have chosen to pay by credit card, the contract is concluded at the time you are debited.
  • If another payment provider such as PayPal is offered and chosen, the contract is concluded as soon as your payment has been transferred to the provider.

3 Site Information and Site Accessibility

www.mademoiselle-chauvin.com is an e-commerce site owned and operated by MADEMOISELLE CHAUVIN, INTOM ART. The Site is open to all internet users and is accessible 24/7, except for interruptions, scheduled or not, by MADEMOISELLE CHAUVIN, for maintenance and/or security purposes or in cases of force majeure. MADEMOISELLE CHAUVIN cannot be held liable for any damage, of whatever nature, resulting from unavailability of the Site. MADEMOISELLE CHAUVIN reserves the right to modify the Site for technical or commercial reasons. When these modifications do not substantially and negatively alter the conditions of service provision, the Customer may be informed of the modifications made, but their acceptance is not requested.

By registering on the Site, the Client guarantees to MADEMOISELLE CHAUVIN that he/she is of legal age and has the legal capacity to enter into a contract.

MADEMOISELLE CHAUVIN may delete the Client's Account at any time, for any reason, at its sole discretion.

4 Products

4.1 Description of products

The products sold by MADEMOISELLE CHAUVIN are those listed on the Site, on the day the Buyer consults the Site and within the limits of available stocks. MADEMOISELLE CHAUVIN reserves the right to withdraw products from sale at any time.

You can consult the characteristics of the products sold on the MADEMOISELLE CHAUVIN website before placing any order.

On the Website, prices may vary depending on the country, delivery method and type of product.

4.2 E-gift card

In the event that e-gift cards are offered on the site, on an ad hoc or permanent basis: MADEMOISELLE CHAUVIN may sell e-gift cards (gift code) which can be used by the customer or transmitted as a gift to third parties.

A product purchased with a gift code can be exchanged by sending a new gift code. The gift code or promo code can be used within 6 months from its issue date.

4.3 Availability of products

(1) Products are offered within the limits of available stocks. MADEMOISELLE CHAUVIN cannot guarantee the availability of the products presented on the site. In the event of unavailability of one of the products, the buyer will be informed as soon as possible by email or telephone of the unavailability of the products and the cancellation of their order.

In the event of cancellation of the order due to unavailability, the buyer's order will be automatically canceled and their bank account will not be debited. If the product is not available and the customer's account has already been debited, MADEMOISELLE CHAUVIN will refund the amount to the debited account as soon as possible. MADEMOISELLE CHAUVIN cannot be held responsible in the event of cancellation of an order due to out of stock.

(2) MADEMOISELLE CHAUVIN is entitled to terminate the contract between the Seller and the Buyer from the moment it does not receive delivery of its goods or if the delivery is incorrect, despite the prior conclusion of the agreement between the two parties. MADEMOISELLE CHAUVIN is required to inform the customer of the unavailability of the service as soon as possible. All sums already paid by the Buyer will be refunded immediately after cancellation of the order.

(3) In the event of a stock shortage, MADEMOISELLE CHAUVIN also reserves the right to establish customer waiting lists for the delivery of its products. In this case, the buyer is debited from his account at the time of the order without being delivered; upon restocking, the ordered product is then sent to the buyer, depending on its position on the waiting list. The waiting times before restocking, indicated to the buyer at the time of the order, are indicative and not contractual. Once the order has been placed and the buyer is registered on the waiting list, the order cannot be canceled. The order may be refunded upon receipt, according to the return and refund terms of these conditions.

5 Prizes

Product prices are indicated in euros on the MADEMOISELLE CHAUVIN website. When the order is finally confirmed, the price takes into account the VAT applicable on the day of the order and any possible delivery costs. MADEMOISELLE CHAUVIN reserves the right to modify delivery costs at any time before the Buyer confirms the order.

The price charged to the Buyer will be the price indicated at the time of final payment and the price indicated in the confirmation email. Shipping costs will be specified in paragraph 7.2 of the following general conditions of sale.

6 Orders

By confirming payment for the order, the Buyer unreservedly accepts the general terms and conditions of sale of MADEMOISELLE CHAUVIN, as well as the confidentiality policy.

(1) Each product that the Buyer wishes to add to the order must be added to the cart by clicking on "Add". A summary of the total items will be shown before proceeding to payment.

(2) Any order on the MADEMOISELLE CHAUVIN Website requires information from the Buyer in order to deliver the goods and process payment. When placing the first order, MADEMOISELLE CHAUVIN sends the Buyer an account confirmation email. The Buyer is not required to create an account, but with this account they will be able to access the customer data they provided when placing the first order, and benefit from gifts and discounts from MADEMOISELLE CHAUVIN.

(3) In order to proceed with the purchase, the Buyer must enter and verify the billing and delivery address as well as the payment method. Once the payment has been validated, a confirmation email will be sent to the email address provided in advance. The Buyer is recommended to keep this document.

(4) MADEMOISELLE CHAUVIN takes the greatest care in the presentation and description of these products to best satisfy the Customer's information needs. It is possible that the Customer may receive, following an Order, a part previously returned by another person. It is specified that MADEMOISELLE CHAUVIN only accepts the return of intact and unused Products, these two conditions being checked before the returned Products are put back into stock.

7 Delivery, shipping costs and transport

7.1 Delivery

MADEMOISELLE CHAUVIN delivers its merchandise using external shipping services such as Colissimo. MADEMOISELLE CHAUVIN delivers its products directly to your home or to a parcel relay point, and does not have any physical points of sale.

The shipping time is 1 to 2 working days, and the delivery time of the products is 2 to 5 working days depending on the country and delivery methods.

7.2 Shipping costs

Delivery costs are indicated before payment of the order. A price list is available on the Delivery Rates page.

In some countries outside the European Union, the Buyer may be subject to additional customs and shipping fees. MADEMOISELLE CHAUVIN will not be held responsible for the payment of these additional fees and believes that it is the consumer's responsibility to inquire about the customs fees of the country in which they are located.

7.3 Transport and damage

If the goods are delivered with obvious damage due to transport, the Buyer must inform the delivery company (Colissimo or Chronopost) without delay and contact MADEMOISELLE CHAUVIN customer service immediately to enable the latter to process complaints as quickly as possible. Any complaints regarding damage related to delivery made after the delivery date may not be taken into account by MADEMOISELLE CHAUVIN.

7.4 Delivery terms

Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residential address of the Customer, a natural person of their choice or a legal entity (delivery to their company). Delivery cannot be made to hotels or PO boxes. The Customer must ensure the accuracy and completeness of the data they provide. The Customer is required to always update their personal information. In the event of an error in the recipient's contact details, MADEMOISELLE CHAUVIN cannot be held responsible for the impossibility of delivering Products.

If Delivery is not possible, the carriers appointed by MADEMOISELLE CHAUVIN will endeavor to find a secure location to deposit the Product. The carriers appointed by MADEMOISELLE CHAUVIN will also leave a notice at the delivery address indicating the location of the Product and the procedure to follow to proceed with a new Delivery. In the event of an incorrect address or if the Customer does not collect the Product, the Customer may contact MADEMOISELLE CHAUVIN or the carrier to arrange redelivery of the Order to a collection point. Otherwise, the Product will be returned to the MADEMOISELLE CHAUVIN warehouse.

In the event that the goods are returned to MADEMOISELLE CHAUVIN's warehouses, no reshipment will be possible and the Customer will be reimbursed within a reasonable period of time from receipt of the goods.

MADEMOISELLE CHAUVIN delivers Orders within a maximum period of 14 (fourteen) working days for Delivery in Metropolitan France and 20 (twenty) working days for International Delivery (Europe), this period being counted from the day after the Order is validated. The day after a new product is put online or a restocking occurs, and throughout the month of December, the Delivery time may be increased by 10 (ten) days, given the volume of Orders.

In order for these deadlines to be met, the Customer must ensure that they have provided accurate and complete information regarding the Delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

MADEMOISELLE CHAUVIN cannot be held responsible for delays in delivery that are not its fault or justified by a case of force majeure (as defined below).

In the event of the Delivery deadline being exceeded, the Customer may request cancellation of the sale and obtain, within a maximum period of 14 (fourteen) days of his request to this effect, the reimbursement of the sums paid on the occasion of the Order. Notwithstanding the above, MADEMOISELLE CHAUVIN cannot be held responsible for the harmful consequences resulting from a delay in delivery, only the reimbursement of the Product by MADEMOISELLE CHAUVIN being possible to the exclusion of any other form of compensation.

8 Payment Conditions

The Buyer has the following payment options:

Credit card (Blue, Visa, Eurocard, Mastercard)

  • Your transaction will be carried out securely, in accordance with 3DS standards.
  • Your account will be debited as soon as the order process is complete.

PayPal System

You pay the invoice amount online via PayPal. Personal and financial information is sent to PayPal servers. You must be registered or have a PayPal account to confirm the payment instruction (except in the case of guest access). Additional information is available during the order transaction.

Payment in 3 installments (Alma)

You pay the invoice amount online via Alma. Personal and financial information is sent to Alma's servers, which ensures payment in three installments, according to the terms indicated at the time of payment, at no additional cost. Additional information is available during the order transaction.

Gift code and promo code

The Buyer may pay the full or partial amount using a gift code or promotional code. To do this, simply enter the code provided at the time of payment and validate it. The amount of the gift code or promotional code will then be deducted from the total amount and the Buyer can continue with their order.

9 Right of withdrawal, reimbursement and return of goods

9.1 Right of withdrawal

The Buyer has a period of 14 (fourteen) days from receipt of the order to exercise his legal right of withdrawal.

The Buyer exercising his right of withdrawal under the conditions provided for in this article (9.1.1) in terms of time limits and methods of returning the products, may obtain a refund corresponding to the amount of the returned products. If the buyer wishes to exchange his order, he must proceed to the refund of his order, then return to the site to place a new order.

9.1.1 Terms of return of goods

(1) The procedure is explained to each buyer who requests it via the contact form. The Buyer has 14 days to exercise his right of withdrawal from receipt of the order, in compliance with the return conditions.

(2) Products must be returned to MADEMOISELLE CHAUVIN in a condition suitable for resale (products in perfect condition accompanied by their original packaging, accessories, instructions, etc.), except in the case of delivery damaged by the post. Only unused MADEMOISELLE CHAUVIN products can be returned and refunded. If the MADEMOISELLE CHAUVIN product has been used by the Buyer, then the product cannot be refunded (except for special offers). MADEMOISELLE CHAUVIN inspects the goods returned by the buyer to ensure that they comply with these return conditions before issuing a refund. If a used product or unsupported goods are returned to MADEMOISELLE CHAUVIN by the buyer, if they are not refunded, this product or goods may be returned to the buyer, at their expense and at their request.

(3) The Buyer must return the goods to the address indicated by customer service. The procedure is explained to each buyer who requests it via the contact form.

9.2 Commercial guarantee

The Buyer has 14 days to activate this guarantee from the receipt of the package. He must respect the above terms and conditions regarding reimbursement and return of the goods.

Misuse of the commercial warranty is prohibited. In addition, repeated returns are prohibited. The Buyer is entitled to only one return and one refund per order. Each order may only contain one product.

9.2.1 Satisfaction or money back operation

During certain specific periods, the site displays a Satisfied or refunded operation, the terms and conditions of which are explained here . Only during these periods, if the return conditions are respected, the MADEMOISELLE CHAUVIN customer service will proceed with the refund upon receipt of the returned merchandise and the order form received with the order. This form must be completed by the buyer at the time of return. Without this duly completed order form, MADEMOISELLE CHAUVIN does not guarantee the refund. The customer service will notify the Buyer by email of its receipt. The customer service will then take the necessary steps to refund the merchandise within a reasonable time following receipt of the return.

Any refund will be made by the same payment method used for payment of the initial merchandise.

If the order was purchased with a gift code, the refund will be made by sending a new gift code for the same amount by email.

If the order is purchased with a promo code, the refunded amount will be the amount paid after the promotion has been applied. The promo code can only be used once and will not be reissued or reusable in the event of a refund for an order where it has been used by the Buyer.

10 Retention of title

ALL TIGERS retains full ownership of the products sold until full payment of the price, including principal, fees, taxes and mandatory contributions.

11 Intellectual Property

The MADEMOISELLE CHAUVIN website and everything contained therein (images, logos, videos, texts, etc.) is the exclusive property of MADEMOISELLE CHAUVIN. Any total or partial reproduction is prohibited and punishable by law.

12 Obligations of the buyer

Following the purchase of a product, MADEMOISELLE CHAUVIN offers the Buyer the opportunity to publish photos of their product or photos involving the use of their product on social media. The Buyer authorizes MADEMOISELLE CHAUVIN to reproduce and distribute this public content on the MADEMOISELLE CHAUVIN website and social media. MADEMOISELLE CHAUVIN is not responsible for the Buyer's messages accompanying the publications of MADEMOISELLE CHAUVIN content on social media. The Buyer nevertheless undertakes to ensure that the content they post complies with the law, and in particular that no comments can be considered illegal, discriminatory, racist, or violent.

13 Legal guarantees and limitation of liability

MADEMOISELLE CHAUVIN's liability with respect to any Product purchased on the Site is strictly limited to the purchase price of the latter. MADEMOISELLE CHAUVIN shall under no circumstances be liable for the following losses, regardless of their origin:

  • loss of income or sales
  • operating loss
  • loss of profits or contracts
  • loss of expected savings
  • data loss
  • loss of work or management time
  • image damage
  • loss of opportunity, and in particular of ordering a Product,
  • moral prejudice.

The documents, descriptions and information relating to the Products appearing on the Site are not covered by any guarantee, express or implied, except for the guarantees provided by law.

MADEMOISELLE CHAUVIN provides no guarantee regarding any damage that may be caused by the transmission of a computer virus, (or other computer programs such as worms, time bombs, Trojan horses, cancelbots, logic bombs) or any other form of programming routine designed to damage, destroy or otherwise impair any functionality of a computer or to hinder the proper functioning of the latter, including any transmission resulting from a download of any content carried out by the Customer, the software used by the Customer to download the content, the Site or the server that provides access to it. In this regard, the Customer acknowledges that it is his responsibility to install appropriate anti-virus and security software on his computer hardware and any other device in order to protect them against any bugs, viruses or other programming routines of this nature that prove harmful. The Customer acknowledges that they assume all risks associated with any content downloaded or otherwise obtained through the use of the Site and agrees that they are solely responsible for any damage to their computer system or loss of data resulting from the download of this content.

MADEMOISELLE CHAUVIN is required to deliver Products that comply with the contractual provisions. Products are considered to comply with the contractual provisions if the following conditions are met: (i) they must comply with the description and possess the characteristics set out on the Site; (ii) they must be suitable for the purposes for which products of this type are generally designed; (iii) they must meet the quality and resistance criteria that are generally accepted for products of the same type and which can reasonably be expected.

In addition, MADEMOISELLE CHAUVIN guarantees consumers against defects of conformity and hidden defects for the Products on sale on the Site under the following conditions:

Apparent defect

The presence of an apparent defect on a Product must give rise to a complaint by contact form or email (hello@all-tigers.com) within three working days following Delivery. Any complaint must explain the defect concerned. Otherwise, no complaint is admissible, and no return or exchange is possible. The Product must be returned, in its original packaging, in its original condition, new, unused, with the references of the initial Order and a copy of the complaint to the head office of MADEMOISELLE CHAUVIN, after sending an email reporting the apparent defect of the Product referred to above. Cases of apparent defect confirmed by MADEMOISELLE CHAUVIN give rise, depending on the content of the Customer's complaint, to either the establishment of a credit note for the benefit of the Customer, or the replacement of the Product, or the outright reimbursement of the Price to the Customer within 14 days. In the event of non-compliance with the return procedure, no exchange, refund or credit note is possible.

Non-conformity – Hidden defects

Subject to validation of a non-conformity or a hidden defect by MADEMOISELLE CHAUVIN or the manufacturer as the case may be, the Customer benefits from the following guarantees:

MADEMOISELLE CHAUVIN, whose registered office is located at 32 Chemin de la chapelle St Antoine 06400 Cannes, France, acts as guarantor within the meaning of the provisions of Articles L 217-5 et seq. of the Consumer Code and 1641 et seq. of the Civil Code.

Thus the Client:

  • benefits from a period of two (2) years from delivery of the Product to take action in the event of non-conformity of the Product,
  • is exempt from providing proof of the existence of the lack of conformity of the goods during the six (6) months following delivery of the Product,
  • may choose between repair or replacement of the Product, subject to the cost conditions provided for in article L217-9 of the Consumer Code;

The legal guarantee of conformity applies independently of the commercial guarantee described below.

In addition, the Customer may also implement the legal guarantee for hidden defects in the item sold, within the meaning of Articles 1641 et seq. of the Civil Code. The legal guarantee for hidden defects allows the Customer, within two years of the discovery of the defect, to be reimbursed for a Product that has proven unfit for its use.

The hidden defects warranty allows the Customer to be protected against hidden defects in the Product purchased which prevent its use or affect it to such an extent that the Customer would not have purchased it.

The Customer then has two options: keep the Product and request a price reduction, or return the Product and request a refund of the price paid, in accordance with Article 1644 of the Civil Code.

In order to implement these guarantees, the Product must be returned, in its original packaging, in its original condition, new, unused, with the references of the initial Order and a copy of the complaint to the head office of MADEMOISELLE CHAUVIN, after sending an email indicating the reason for the return of the Product.

For all useful purposes, the following legal provisions are recalled:

Art. L217-4 of the Consumer Code: "The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made his responsibility by the contract or has been carried out under his responsibility."

Art. L217-5 of the Consumer Code: “The good is in conformity with the contract: 1° If it is suitable for the use usually expected of a similar good and, where applicable (a) if it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model; (b) if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling; 2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.”

Art. L217-7 of the Consumer Code: “Lack of conformity that appears within twenty-four months of delivery of the goods is presumed to have existed at the time of delivery, unless proven otherwise. For goods sold second-hand, this period is set at six months. The seller may challenge this presumption if it is not compatible with the nature of the goods or the alleged lack of conformity.”

Art. L217-8 of the Consumer Code: “The buyer is entitled to demand that the goods conform to the contract. However, he cannot contest conformity by invoking a defect that he knew about or could not have been unaware of when he entered into the contract. The same applies when the defect originates from the materials that he himself supplied.”

Art. L217-9 of the Consumer Code: "In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods. However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate to the other method, taking into account the value of the goods or the extent of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer."

Art. L217-10 of the Consumer Code: “If the repair and replacement of the goods are impossible, the buyer may return the goods and have the price refunded or keep the goods and have part of the price refunded. The same option is open to him: 1° If the solution requested, proposed or agreed upon in application of Article L. 217-9 cannot be implemented within one month following the buyer’s complaint; 2° Or if this solution cannot be implemented without major inconvenience for the buyer, taking into account the nature of the goods and the use he is seeking. However, the sale cannot be cancelled if the lack of conformity is minor.”

Art. L217-11 of the Consumer Code: “The application of the provisions of Articles L. 217-9 and L. 217-10 takes place at no cost to the buyer. These same provisions do not prevent the allocation of damages.”

Art. L217-12 of the Consumer Code: “The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.”

Art. L217-13 of the Consumer Code: “The provisions of this section do not deprive the buyer of the right to exercise the action resulting from latent defects as it results from articles 1641 to 1649 of the Civil Code or any other action of a contractual or extra-contractual nature which is recognized by law.”

Art. 1641 of the Civil Code: “The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have paid a lower price for it, if he had known of them.”

Art. 1642 of the Civil Code: “The seller is not liable for apparent defects of which the buyer has been able to convince himself.”

Art. 1643 of the Civil Code: “He is liable for hidden defects, even if he was not aware of them, unless, in this case, he has stipulated that he will not be obliged to provide any guarantee.”

Art. 1644 of the Civil Code: “In the case of Articles 1641 and 1643, the buyer has the choice of returning the item and having the price refunded, or of keeping the item and having part of the price refunded.”

Art. 1646 of the Civil Code: “If the seller was unaware of the defects in the item, he will only be required to return the price and reimburse the purchaser for the costs incurred by the sale.”

Art. 1648 of the Civil Code: “The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect. (…)”

Force Majeure

In the event of the occurrence of a force majeure event preventing the execution of these General Terms and Conditions, MADEMOISELLE CHAUVIN shall inform the Customer within fifteen (15) days of the occurrence of this event, by email or by registered letter with acknowledgment of receipt. Expressly considered as cases of force majeure or fortuitous events, in addition to those usually recognized by the jurisprudence of French courts and tribunals, are total or partial strikes, lockouts, riots, boycotts or other actions of an industrial nature or commercial disputes, civil unrest, insurrection, war, bad weather, epidemic, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes in forms of marketing, computer breakdown, blockage of telecommunications, including wired or wireless telecommunications networks, and any other case beyond the control of the parties preventing the normal execution of the contractual relationship. All obligations of the parties are suspended for the duration of the force majeure event, without compensation. If the force majeure event continues for more than three (3) months, the transaction concerned may be terminated at the request of MADEMOISELLE CHAUVIN or the Client without compensation from either party. Failure to pay by the Client cannot be justified by a case of force majeure.

15 Partial disability

If one or more provisions of these T&Cs are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope.

16 Non-waiver

No tolerance, inaction or inertia on the part of MADEMOISELLE CHAUVIN may be interpreted as a waiver of its rights under the T&Cs.
